2. Services Provided
Platinum Marketing Agency provides website development, digital marketing, branding, hosting, SEO, and related services. The scope of each project is outlined in an individualized proposal or service agreement. All services are provided based on the specifications approved by the client.
3. Quotes, Proposals & Payment Terms
All quotes and proposals are valid for 30 days from issuance unless stated otherwise.
Work begins once payment terms are met as outlined in the service agreement.
Monthly service plans, retainer packages, and subscription-based services are billed automatically unless canceled in accordance with Section 10.
Late payments may result in service interruption, suspension of hosting, or delays in project delivery.
4. Client Responsibilities
Clients agree to:
Provide all content, materials, passwords, and required information in a timely manner.
Review drafts, proofs, and site previews promptly.
Ensure that all provided content (text, images, media, etc.) is owned by the client or properly licensed.
Platinum Marketing Agency is not liable for delays caused by a client’s failure to provide required materials or approvals.
5. Project Timelines
Timeline estimates are provided as guidelines and may shift based on:

Project complexity
Scope changes
Technical requirements
Platinum Marketing Agency is not responsible for delays caused by third-party platforms, hosting services, plug-ins, or external vendors.
6. Revisions & Scope Changes
Each project includes a defined number of revisions as outlined in the service agreement. Additional revisions, feature requests, or scope modifications may incur added fees.
7. Website Launch & Post-Launch Support
A project is considered complete once the website is launched or final files are delivered. After launch:
Any updates, bug fixes, or maintenance requests fall under a monthly care plan or hourly billing unless previously included in a package.
Platinum Marketing Agency is not responsible for post-launch changes made by the client or unauthorized third parties.
8. Ownership & Intellectual Property
Final designs, website layouts, and approved deliverables become the property of the client upon full payment.
Proprietary tools, processes, templates, code libraries, and internal assets remain the property of Platinum Marketing Agency.
We reserve the right to showcase completed projects in our portfolio unless the client requests otherwise in writing.
9. Hosting & Third-Party Services
Platinum Marketing Agency may provide hosting services or recommend third-party providers.
We are not responsible for:
Downtime
Security breaches
Performance issues
Third-party policy changes
Data loss from third-party platforms
Clients are encouraged to maintain their own backups and security protocols.
10. Cancellations & Refunds
Because services involve time, planning, and labor, all payments made are non-refundable unless otherwise stated in your agreement.
Monthly plans may be canceled with a 30-day written notice via email to contact@platinummarketingagency.com
Work completed prior to cancellation will be billed accordingly.
11. Limitation of Liability
Platinum Marketing Agency is not liable for:
Loss of revenue or profits
Business interruptions
Website downtime or security issues
Errors resulting from client-provided content
Outcomes of SEO, advertising, or marketing performance (as results vary)
Our total liability is limited to the amount paid by the client for the specific service in question.
12. Confidentiality
Both parties agree to keep all business, financial, and project-related information confidential unless required by law or mutually agreed upon in writing.
13. Privacy & Data Usage
Client information is used solely for communication and service delivery. By using our services, you agree to our Privacy Policy. (If you need a Privacy Policy drafted, I can create one.)
14. Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes will be handled through binding arbitration or mediation in Dallas County, unless otherwise mutually agreed.
15. Changes to Terms
Platinum Marketing Agency may update these Terms at any time. Continued use of our services after changes are made signifies acceptance of the updated Terms.
